1. Who we are (the Controller)
This Privacy Policy explains how we collect and process your personal data when you use ImagikaBot, including the Telegram bot @imagikabot and the website https://imagika.cc (together, the “Service”). The data controller is an individual entrepreneur (sole proprietor) registered in Georgia: Vitaly Sokolov, identification number 306408704, Georgia (the “Controller”, “we”, “us”). 2. Scope
This Policy applies to users located outside the Russian Federation and to users who are not citizens of the Russian Federation. Users who are citizens of and/or located in the Russian Federation are covered by a separate Russian-language policy, under which the controller is a self-employed person registered in Russia. Where we offer the Service to individuals in the European Economic Area (EEA) or the United Kingdom, we process personal data in accordance with the EU General Data Protection Regulation (GDPR) and the UK GDPR. As a controller established in Georgia, we also comply with the Law of Georgia on Personal Data Protection.
3. Personal data we collect
• Telegram User ID — your unique identifier in Telegram; • Telegram username (if available); • Phone number linked to your Telegram account — only if you voluntarily provide it, for identification and contact; • Content you submit — text prompts and parameters you enter to generate images, and the images generated for you; • Website data — when you visit https://imagika.cc, technical data automatically sent by your device, such as IP address, browser and device information, cookies, and analytics data; • Communications — information you provide when you contact support. We do not intentionally collect special categories of data. Please do not submit other people’s personal data or sensitive personal data through the Service.
4. Purposes and legal bases (GDPR Art. 6)
• To provide the Service, create and manage your account, and deliver image-generation features — legal basis: performance of a contract (Art. 6(1)(b)); • To provide customer support and communicate with you about the Service — performance of a contract and our legitimate interests (Art. 6(1)(b) and (f)); • To maintain security, prevent abuse and fraud, and ensure the proper functioning of the Service — legitimate interests (Art. 6(1)(f)); • To analyse and improve the Service using aggregated/anonymised statistics — legitimate interests (Art. 6(1)(f)); • To send marketing messages about features, offers and pricing — only with your consent (Art. 6(1)(a)); you may withdraw consent at any time; • To comply with legal obligations applicable to us — Art. 6(1)(c).
5. Marketing communications
We send promotional messages only if you have given prior, separate consent. You can withdraw consent and unsubscribe at any time via the unsubscribe option or by contacting hello@imagika.cc. Withdrawing consent does not affect the lawfulness of processing before withdrawal and does not affect your ability to use the Service.
6. Sharing your data and processors
We do not sell your personal data. We share it only with service providers (processors) acting on our instructions under data processing agreements, including: • Image-generation providers (third-party AI APIs) that process the prompts and parameters needed to generate images; • Hosting and infrastructure providers; • Analytics providers (for the website); • Public authorities, where required by applicable law. Telegram LLC operates the messaging platform through which the bot is delivered and processes your data under its own terms and privacy policy; Telegram is not our processor.
7. International data transfers
Some of our processors (for example, image-generation APIs) may be located outside the EEA, the UK or Georgia. Where we transfer personal data internationally, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses (SCCs) and, for UK data, the UK International Data Transfer Addendum, together with supplementary measures where necessary. You may request a copy of the relevant safeguards by contacting us.
8. Retention
We keep personal data only as long as necessary for the purposes described above. Account data is retained for the duration of your use of the Service and deleted within thirty (30) days after account closure or withdrawal of consent, unless we are required to keep it longer by law. Prompts and generated images are retained only as needed to provide the Service. Aggregated/anonymised data may be kept indefinitely.
9. Your rights
Subject to applicable law, you have the right to: access your personal data; rectify inaccurate data; erase data (“right to be forgotten”); restrict or object to processing; data portability; and withdraw consent. Where processing is based on legitimate interests, you may object at any time. To exercise your rights, contact us at hello@imagika.cc. We will respond within one month. You also have the right to lodge a complaint with your local data protection supervisory authority (in the EEA or UK) or, in Georgia, with the Personal Data Protection Service of Georgia.
10. Cookies
The website uses cookies and similar technologies. Strictly necessary cookies are used to operate the site; analytics and other non-essential cookies are used only with your consent, which you can manage through the cookie banner or your browser settings.
11. Children
The Service is not directed to children. You must be at least 18 years old (or the age of digital consent in your country) to use the Service, or have the consent of a parent or guardian. We do not knowingly process children’s data without the required consent and will delete it if discovered.
12. Security
We implement appropriate technical and organisational measures to protect personal data against unauthorised access, loss, alteration or disclosure. In the event of a personal data breach, we will notify the competent supervisory authority and, where required, affected users in accordance with applicable law.
13. Changes to this Policy
We may update this Policy from time to time. The current version is always published at https://imagika.cc. Material changes will be communicated through the Service. Continued use after the effective date constitutes acceptance of the updated Policy.
